PARTICIPATION WAIVER
By checking the box below and typing my name, I agree to this Participation Waiver, which governs my participation in the Dadcathalon event (the “Event”), organized by Dadcathalon and its officers, directors, sponsors, affiliates, employees, contractors, volunteers, and agents (the “Released Party”).
1. ASSUMPTION OF RISK I understand that participation in the Event involves inherent risks, including but not limited to serious injury, illness, property damage, or death, arising from physical activity, weather, equipment, terrain, acts of others, and other hazards. I knowingly and voluntarily assume all such risks.
2. RELEASE OF LIABILITY
In consideration of being allowed to participate, I hereby release, waive, discharge, and covenant not to sue the Released Party from any liability, claims, demands, or damages arising from injury, illness, death, or property loss related to the Event, whether caused by the negligence of the Released Party or otherwise, to the fullest extent allowed by Utah law.
3. INDEMNIFICATION
I agree to defend, indemnify, and hold harmless the Released Party from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of: my acts or omissions; my negligence; or any injury or damage I cause to third parties during the Event.
4. PHOTO/VIDEO RELEASE
I grant the Released Party the right to record, use, reproduce, and publish any photo, video, or audio of me from the Event for any lawful purpose, without compensation.
5. GOVERNING LAW / SEVERABILITY
This Waiver is governed by Utah law (including Utah Code Ann. § 78B-4-203). If any portion is found invalid, the remainder shall remain in effect.
6. ELECTRONIC ACCEPTANCE
By checking the box and entering my name and date, I acknowledge that I have read, understand, and voluntarily agree to this Waiver. I am of legal age, or the parent/legal guardian of a minor participant.
